Important: These Terms of Service constitute a legally binding agreement between you and TixPulse. By creating an account or using our services, you agree to be bound by these terms. Please read them carefully. If you do not agree, do not use TixPulse.
These Terms of Service ("Terms") govern your access to and use of the TixPulse platform, including the website at tixpulse.io, mobile web applications, browser extensions, and all related services (collectively, the "Service"). By accessing or using the Service in any manner, including by clicking "I agree," creating an account, or simply using the Service, you represent that: (a) you have read, understood, and agree to be bound by these Terms and our Privacy Policy; (b) you are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater; and (c) you have the legal authority and capacity to enter into a binding agreement.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" include that organization.
We reserve the right to modify these Terms at any time. Material changes will be communicated by email and via a prominent notice on the Service at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
TixPulse is a ticket price monitoring and alert service that: (a) monitors publicly accessible secondary market ticket listings across multiple third-party platforms; (b) notifies registered users when ticket prices reach their specified target price; (c) provides AI-generated deal scores, price history, and event recommendations; and (d) facilitates navigation to third-party ticket platforms where users may purchase tickets directly.
TixPulse is not a ticket seller, ticket broker, or ticketing platform. We do not sell, hold, transfer, or guarantee the availability or price of any ticket. All ticket purchases occur directly between users and third-party ticket platforms subject to those platforms' own terms and conditions. TixPulse is not a party to any ticket purchase transaction.
To access most features of the Service, you must create an account by providing accurate, current, and complete registration information. You agree to promptly update your account information to keep it accurate. You may not impersonate another person, use a false identity, or create an account on behalf of someone else without their authorization.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to: (a) use a strong, unique password; (b) notify us immediately at hello@tixpulse.io if you suspect unauthorized access to your account; and (c) ensure you log out of your account at the end of each session on shared devices. TixPulse will not be liable for any loss or damage arising from unauthorized use of your account that results from your failure to maintain adequate security.
We reserve the right to suspend or terminate your account, without prior notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or if continued provision of service poses a legal, security, or business risk to TixPulse. You may delete your account at any time via your account settings or by contacting hello@tixpulse.io.
TixPulse offers a free plan and paid subscription plans (Basic, Pro, and VIP) as described on our pricing page. Paid plans are billed on a monthly or annual basis as selected at the time of subscription. Features, alert limits, and check intervals vary by plan and are subject to change with reasonable notice.
By subscribing to a paid plan, you authorize TixPulse, through our payment processor Stripe, Inc., to charge your payment method on a recurring basis at the then-current subscription rate until you cancel. Subscription fees are charged in advance at the start of each billing period. All fees are non-refundable except as expressly stated in Section 4.5 or as required by applicable law.
If a payment fails, we will retry the charge and may notify you by email. Continued payment failure may result in suspension or downgrade of your account to the free plan. You are responsible for maintaining valid payment information in your account settings.
We reserve the right to change subscription prices. We will provide at least 30 days' advance notice of any price increase via email to your registered address. Price changes will not affect your current billing period and will take effect at the start of your next billing cycle. If you do not agree to a price change, you must cancel your subscription before the price change takes effect.
You may cancel your subscription at any time through your account settings or by contacting hello@tixpulse.io. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of your paid billing period. After cancellation, your account reverts to the free plan. We do not provide prorated refunds for partial billing periods, except where required by law.
Subscription fees are generally non-refundable. We may, at our sole discretion, provide a refund or service credit in cases of significant service outages directly caused by TixPulse infrastructure failures that persist for more than 24 continuous hours within a billing period. Any refund requests must be submitted within 30 days of the billing date at issue. We do not provide refunds based on failure to receive an alert where the price did drop, missed purchases, or outcomes of ticket transactions.
You may use TixPulse solely for your own personal, non-commercial purpose of monitoring ticket prices and receiving price alerts for events you personally intend to attend.

Violation of these prohibited activities may result in immediate termination of your account and may expose you to civil and criminal liability.
TixPulse monitors publicly accessible ticket listings and delivers alerts based on prices observed at the time of each monitoring check. The Service operates on defined check intervals (30 minutes on Free and Basic plans, 10 minutes on Pro, 5 minutes on VIP) and may not capture every price change between checks. A price may drop below your target and rise again between checks without triggering an alert.
Ticket prices, availability, and listing data displayed by TixPulse are retrieved from third-party platforms and may be subject to delays, inaccuracies, errors, or omissions. Prices may change between the time they are scraped and the time you view them or attempt to purchase. TixPulse does not guarantee that any price displayed is currently available or that tickets at the displayed price can be successfully purchased.
While we strive to deliver alerts promptly, we do not guarantee delivery of alerts within any specific timeframe. Alert delivery depends on the availability of third-party email, SMS, and push notification services (SendGrid, Twilio, and browser push infrastructure), which are outside our direct control. We are not responsible for delays, failures, or non-delivery of alerts caused by third-party service outages, spam filters, carrier issues, or device-level notification settings.
The AI deal score and event recommendations provided by TixPulse are generated by artificial intelligence models and are provided for informational purposes only. They do not constitute financial advice, investment advice, or a guarantee of any outcome. Past price patterns are not indicative of future prices. You should exercise your own judgment when making ticket purchase decisions.
TixPulse participates in affiliate programmes with third-party ticket platforms including StubHub, SeatGeek, Vivid Seats, Ticketmaster, AXS, Gametime, TickPick, Eventbrite, and Songkick. When you click a buy link on TixPulse and make a purchase on a third-party platform, TixPulse may receive a commission from that platform at no additional cost to you. The existence of these affiliate relationships does not influence how we present price data or which platform's prices we surface — all prices are shown objectively.
All ticket purchases occur exclusively on third-party platforms. TixPulse is not responsible for: (a) the accuracy or completeness of listings on third-party platforms; (b) the fulfillment, quality, or legitimacy of tickets purchased through third-party platforms; (c) pricing errors, hidden fees, or service charges imposed by third-party platforms; (d) event cancellations, postponements, or venue changes; or (e) any disputes between you and a third-party platform. All ticket purchase disputes should be directed to the relevant platform.
The TixPulse platform, including its design, software, algorithms, trademarks, logos, text, graphics, and all other content created by or for TixPulse, is owned by or licensed to TixPulse and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, reproduce, modify, distribute, display, transmit, or create derivative works based on any part of the Service without our prior written permission.
The TixPulse name and logo are trademarks of TixPulse (USPTO application pending). You may not use these marks without our prior written consent.
By submitting content to TixPulse, including support messages, feedback, or suggestions, you grant TixPulse a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and incorporate that content into the Service without obligation to you. We are not obligated to keep any submitted content confidential or to respond to or implement any feedback.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TIXPULSE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TIXPULSE DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY PRICE INFORMATION WILL BE ACCURATE, COMPLETE, OR CURRENT; (C) ANY ALERT WILL BE DELIVERED WITHIN ANY PARTICULAR TIMEFRAME; (D) THE SERVICE WILL MEET YOUR REQUIREMENTS; OR (E) DEFECTS IN THE SERVICE WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIXPULSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF TIXPULSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TIXPULSE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS PAID BY YOU TO TIXPULSE IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless TixPulse and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service in an unauthorized or unlawful manner; (c) your violation of any third party's rights, including intellectual property rights; (d) any content you submit to the Service; or (e) your violation of any applicable law or regulation.
Before initiating any legal proceeding, you agree to contact us at hello@tixpulse.io to attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receipt of your notice. If the dispute is not resolved within 30 days, you may proceed with formal dispute resolution as described below.
EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT OR RELATE TO INTELLECTUAL PROPERTY RIGHTS, ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA), CONDUCTED ON AN INDIVIDUAL BASIS. THE ARBITRATION SHALL BE CONDUCTED IN ENGLISH, AND THE ARBITRATOR'S DECISION SHALL BE FINAL AND BINDING. JUDGMENT ON THE ARBITRATION AWARD MAY BE ENTERED IN ANY COURT OF COMPETENT JURISDICTION.
YOU AND TIXPULSE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
TixPulse is designed and operated in compliance with the Better Online Ticket Sales (BOTS) Act of 2016 (15 U.S.C. §45c) and applicable state anti-scalping laws. TixPulse is a consumer price-monitoring tool that helps individual fans purchase tickets for their personal use at fair prices. TixPulse does not use or facilitate the use of bots, automated purchasing software, or means to circumvent ticket purchase limits or security measures implemented by ticket sellers. Any use of TixPulse in connection with automated ticket purchasing, scalping, or resale activity is expressly prohibited by these Terms and may constitute a federal crime.
TixPulse reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may add or remove features, change plan limits, add new platforms, or discontinue monitoring of specific platforms. In the event of a material reduction in the features available on your paid plan, we will notify you by email and provide a prorated refund for the affected period if we are unable to restore the feature within 7 days.
